How do you know if electronic signatures are trustworthy?
he 2001 E-Sign Act
was intended to ease and encourage the use of esign technology;
however, years later, there is still a lot of mistrust of electronic
signatures, even though they are evidently more secure and efficient
than their handwritten counterparts.
With that said; how can you be sure that when you esign online your documents and information contained in it is safe? In addition, how do you know if the e-signature you are about to execute is trustworthy?
Why this matters
It’s common for people to sometime question about a
contract’s originality and validity. Such people could claim that a
particular electronic document has failed to conform to the E-Sign Act,
hence prompting endless court battles.
Actually, the cause of many potential legal issues with contracts signed electronically
relates to enforceability. For instance, remember the many checkboxes
you click when purchasing goods online? Well, in case of a dispute, a
client who ticks those boxes will later have a difficult time claiming
that they didn’t know what they were signing.
